EPO and CIPA state that Brexit will have no consequence on European patents

At the end of January, a delegation of the European Patent Office (EPO) - led by current EPO president Benoît Batistelli - and UK’s patent attorney organisation CIPA gathered in Munich to discuss the impact of Brexit on the practice of the EPO.

 

Both parties reassured that “Brexit will have no consequence on UK membership of the EPO, nor on the effect of European patents in the UK”.

 

According to Batistelli, Brexit will have no impact on UK membership of the EPO:

 

“the EPO is not an EU agency but an independent international organisation, of which the UK is a founding member.”

 

Both the EPO and CIPA acknowledged the good progress made by the UK on the ratification of the UPC Agreement, which is expected to ratify in the coming months. 15 EU member states have ratified the agreement so far, and more are expected to do so soon.
