Registration procedure trademarks - European Union trade mark

€ 50 for the 2nd class +

When filing the application, two languages must be specified including at least one of the official working languages (EN, FR, DE, IT, ES). We recommend specifying NL as the first language and then EN or FR as the second language as any opposition proceedings must then be conducted in that second language.
Examination of the formal requirements.The administration (EUIPO) examines e.g.whether the claimed products have been correctly classified. If there are any objections, the application can be rectified within two months.

Examination of the intrinsic validity.EUIPO investigates whether the trademark is intrinsically distinctive, not merely descriptive and not misleading. If it is, the trademark is provisionally refused. The applicant can submit arguments within two months to remove the objection. An appeal against a final rejection may be lodged with the EUIPO Board of Appeal.

Publication of the application.The date of publication marks the beginning of the three-month opposition period in which earlier trademark holders can initiate opposition proceedings.
End of the convention priority period.If the trademark has been registered for the first time, the holder may file corresponding applications in other countries within six months. If the priority right is invoked, these corresponding applications are in somehow deemed to be filed at the date of the initial filing (in the EU).

End of the opposition period.If an opposition is lodged, the procedure as such is preceded by a cooling off period. If no agreement is reached, each party can in turn submit arguments. An appeal may be lodged against a decision with EUIPO Board of Appeal.

Registration of the trade mark.If no opposition proceedings have been instituted or if an opposition is rejected/withdrawn, EUIPO registers the trademark whereupon the trademark owner can fully exercise and enforce his rights.

After ten years, the holder may renew the registration for an additional period of ten years upon payment of renewal fees.
